TERMS AND CONDITIONS
Deposits:
A
deposit or full payment is required to reserve any house.
Reservations will be released if deposit is not received within 24
hours.
If a reservation is made within 15 days of stay, immediate
full payment is required. Reservations made outside of 15 days
required a one night minimum deposit. Payment by money order, bank
deposit or transfer, or Pay Pal will confirm your reservation.
Cancellations & Refunds:
Absolutely no refund, for any reason, upon early checkout. (Noise from neighborhood clubs, fireworks, neighbors, etc. does not
constitute valid reason for refund)
All reservations payments are non-refundable unless Rosarito Adventure can re-rent the same property for the same period of time
. Reservations that are re-rented are subject to a $100 processing fee.
Holiday/Event payments are non-refundable regardless of
re-rental.
Reservation may be re-scheduled (Same property and number of nights) up to 21 days prior to departure subject to a
$100 re-scheduling fee. After departure any unused portion of your stay is non-refundable.
If Security denies access to guest because accommodation information does not match guest or number of guests exceeds the
maximum allowed, no refund will be made. Security reserves the right to
demand guest vacate the premises and no refund will be given.
Prices
and Accommodation Substitution - All prices, amenities and service
reflect current rates in effect and are subject to change without
notice. Rosarito Adventure reserves the right to substitute similar
accommodations, or services, and to make adjustments in prices if it is
discovered that a particular price was shown or quoted incorrectly.
Every effort will be made to provide service or accommodations of equal
standards and quality for your safety, convenience and enjoyment. All
prices are in U.S. Dollars ($USD).
Prices
do not include - Expenses and items not mentioned including but not
limited to transportation, tips for personal services, meals,
beverages, parking fees, insurance, resort fees, telephone calls,
laundry service, cleaning and other items of a personal nature.
Baggage
- Neither Rosarito Adventure nor the selling agent shall be responsible
for the loss, damage or delays to customers' baggage.
Physical
Disabilities - Mexico does not conform to the United States' American
Disability standards and, therefore, facilities for disabled persons
are extremely limited in Mexico.
Responsibility
- The houses advertised are provided by Rosarito Adventure. The
suppliers providing transportation, tours, and accommodations for
Rosarito Adventure are independent contractors and are not agents or
employees of Rosarito Adventure. By utilizing the services of the
suppliers you agree that neither Rosarito Adventure nor any of its
representatives shall be liable for any accident, loss, injury or
damage to you or to those traveling with you in connection with any
accommodations, transportation or other services or resulting directly
or indirectly from any occurrences or conditions beyond their control,
including defect in vehicles, breakdown in equipment, poor weather
conditions, strikes, theft, delays, cancellations or changing of
itineraries or schedules, etc. Remember that all travel documents and
required personal identification, as well as compliance with all
customs and immigration regulations, is your responsibility. The terms
under which you agree to take a vacation cannot be changed or amended
except in writing, and must be signed by an authorized officer of
Rosarito Adventure.
Limitation of
Liability - By booking one of these houses you acknowledge that in any
and all events Rosarito Adventure shall not be liable for any
consequential damages and that the sole amount of Rosarito Adventure's
liability shall never exceed the amount actually paid by you to
Rosarito Adventure.
Rules of Mexican
Arbitration - Any controversy or claim arising out of, or relating to,
any of the vacations advertised shall be submitted to binding
arbitration in accordance with the Commercial Arbitration Rules
Customer and Rosarito Adventure understand and agree that by agreeing
to binding arbitration they are giving up the right to trial on the
merits, by either judge or jury, or trial de novo and the right to
appeal.
Any or all Arbitration shall commence in the City of Playas de Rosarito, Mexico.
